司法院大法官釋字第 584 號解釋涉及一個在社會輿論中頗具爭議的問題：針對具有暴力或性犯罪前科之人，政府是否應該逕行禁止其擔任計程車司機，以保障社會大眾搭乘計程車時的生命、身體安全？針對這項爭議，本號解釋認定道路交通管理處罰條例第三十七條第一項之規定合憲，並在推論過程當中，多次引用法務部與內政部警政署所提供的統計數據。值得注意的是，這些統計數據的引用除了凸顯本案判斷所牽涉的案件特性之外，更重要的是在大法官的論理脈絡中，它似乎多少具有補強、支持、甚至在相當程度上正當化大法官論證內容與結果的功能。這一點於是不免促使我們思考下面這個問題：究竟這些事實面的統計資料，在大法官進行合／違憲判斷的過程當中，是處於什麼樣的地位？大法官處理的既然是法律（憲法）問題，那麼他們究竟是如何面對與運用這些呈現在眼前的事實證據？簡單地問：肩負解決法律爭議任務的大法官，到底是如何、又應該如何處理事實呢？本文想要著眼探討的，便是此事實面的實證資料在規範違憲審查這個法律問題論證過程當中的定位問題。本文將透過對釋字第 584 號解釋的觀察與分析，檢討本號解釋對於實證資料的處理在方法上的問題，並進而探討規範違憲審查中事實認定的角色定位所不免涉及之違憲審查與立法兩權之間的權力分立問題。

This essay aims to explore the normative status of fact as well as fact finding/investigation in context of legal and particularly constitutional reasoning from a critical review on No. 584 of Judicial Yuan Interpretation, in which the Justices of the Constitutional Court used a lot of empirical materials in order to justify their conclusion that the Act Governing the Punishment for Violation of Road Traffic Regulations, Article 37, Paragraph 1, is constitutional in disqualifying persons who were convicted of any of the offenses as specified for the occupation of taxicab drivers. While statistical materials seem to play an important role in the reasoning of this constitutional review, whether they were properly used deserves careful examination, since empirical resources must not replace normative evaluation of the Justices of the Constitutional Court against the background of the so called Is-Ought-dichotomy, which the reasoning of No. 584 seems to have ignored.
