臺灣建築工程所使用的交易安全機制,是用來保護契約雙方當事人,包括業主及承包商的權益。一般而言,業主會擔心建築工程是否能被正確地執行且無遲延;而承包商則擔心當工程完成之時或在指定付款日能否獲得全額的給付。我國民法、票據法、動產擔保交易法提供數種交易安全機制,主要是在確保契約當事人的金錢給付義務。而透過契約當事人約定,這些交易安全機制已在建築工程逐漸發展,本文擬介紹這些交易安全機制。
