依據國家通訊傳播委員會民國95年廠商營收的統計資料,國內固網市場與長途網路市場,中華電信的市場占有率分別為 80.65%與 58.13%,至於市內網路的市場,以用戶數為衡量指標,中華電信的市場占有率更高達 97.39%,所以中華電信一直為國家通信傳播委員會(NCC)所公布的市場主導者,亦為公平法所定義之獨占事業。 公平法第 5 條第 3 項的規定,獨占事業之「特定市場」係指「事業就一定之商品或服務,從事競爭之區域或範圍。」事業從事競爭之「範圍」,就是反托拉斯法域中所稱之相關產品市場(relevant product market),而所謂的事業從事競爭之「區域」,則為反托拉斯法域中的相關地理市場(relevant geographic market)。 此外,公平法第 5 條之 1 之規定,事業是否屬於獨占事業,必須具備下列之基本條件:一、事業在特定市場之占有率達二分之一;二、事業全體在特定市場之占有率達三分之二;三、事業全體在特定市場之占有率達四分之三。 根據國家通訊傳播委員會的網站資料,截至民國 96 年 12 月底,六種寬頻上網服務類型的用戶數,其統計分別為:ADSL 為 4,212,227 戶,Cable Modem 為 502,629 戶,Leased Line 為 26,375 戶,PWLAN 為 48,956 戶,3G Phone 為 1,087,475 戶,3G Data Card 為 104,960 戶,六者帳戶合計為 5,982,622 戶。 在上述六類上網服務中,中華電信公司共擁有 3,843,565 戶,占全部寬頻上網服務戶數 5,982,622 戶的 64.25%。根據公平法第 5 條之 1 的原則,中華電信公司應屬於該市場的獨占事業。

In accordance with the 2006 firms' income statistics from National Communications Commission (NCC), the market share of Chunghwa Telecom Corp. (Chunghwa) in domestic fixed, and long-distance network markets are 80.65% and 58.13%, respectively, using the number of subscribers as the measurement. The market share of Chunghwa even achieves a figure of 97.39% in district network market. Therefore, Chunghwa is invariably presumed by NCC as a market leader, and a monopoly in the Fair Trade Law. As regulated by the third term of the fifth clause of the Fair Trade Law, the 'specific market' of monopoly refers to the competitive territory or scope for a certain commodity or service. Of which, the competitive scope associates the 'relevant product market'; while the competitive territory is just the 'relevant geographic market' indicated in the Antitrust Law. Furthermore, the first term of the fifth clause of Fair Trade Law regulates the fundamental conditions of monopoly as: (i) a business possesses a half of market share for a specific market, (ii) two businesses possess a two-third of market share for a specific market, and (iii) three businesses possess a three- fourth of market share for a specific market. It is shown on the NCC website that, till December 2007, the numbers of subscribers for the six types of broadband network service are: ADSL 4,212,227, Cable Modem 502,629, Leased Line 26,375, PWLAN 48,956, 3G Phone 1,087,475, and 3G Data Card 104,960. Of which, Chunghwa possesses 3,843,565 subscribes, accounting for 64.25% of the total number of the six types network service 5,982,622. Thus, according to the first term of the fifth clause of Fair Trade Law, Chunghwa should be a monopoly of the broadband network service market.
