本文除介紹聯邦交易委員會對於資訊隱私案件所持的基本原則，以及相關的案件類型與其限制外，將進一步分析、討論在台灣現有法制架構下，對於欺罔及不公平資訊行為的規範，以及採取類似聯邦交易委員會行政管制措施的可能性。

In 1999, the Federal Trade Commission (FTC) first declared in In re GeoCities that the collection or use of customers’ personal information contrary to a company’s privacy policy constitutes a deceptive practice in violation of Section 5 of the Federal Trade Commission Act. Since 2005, the FTC has expanded its regulatory activities and taken enforcement actions under its unfairness authority. The focus is against companies which failed to provide adequate notice regarding their information practices, or failed to provide reasonable and appropriate security measures in protecting their customers’ personal information.
Compared with the FTC’s actions, relevant agencies in Taiwan, so far have not shown any interests in regulating similar activities. Nonetheless, in the last few years, there have been many information privacy incidents in Taiwan, which may involve deceptive or unfair information practices. How should these practices be regulated under the current laws?
This article will introduce the FTC’s basic positions toward information privacy issues. It also examines the FTC’s deceptive and unfair privacy practice cases and their limitations. Finally, this paper will discuss the applicability and restriction of current Taiwanese laws to deal with deceptive and unfair information practices.
