本文從法國對於生技產業發展之策略與相關生物倫理層面考量因素出發，討論在法國法制上對於臍帶血之可能規範。從法國國家生命科學與健康倫理諮詢委員會之報告中，可以得見法國對於臍帶血銀行，傾向於以國家資源為公益而為發展，而不鼓勵為自體醫療用之私人臍帶血銀行。目前針對臍帶血，並無專門立法，而相關可能適用規範，則為透過法律解釋而適用公共健康法中關於血液與人體組織、細胞之規範部分。此一法律適用，當有其窒礙之處。此外，目前由於法國國內臍帶血存量不足，造成需付出昂貴的進口成本，此一現象也開始使人們重新思考國家資源投入的量必須提升，甚至需要設立私人臍帶血銀行之可能性。未來法國相關法制如何在公益與私益間取得平衡，值得吾人密切觀察。

From the observations of the French strategies on the development of biotechnological industries, and of the relevant considerations of Bioethics, this article focuses the possible regulations of umbilical cord bank in France. The Report of the French National Consultative Committee of Ethics indicated that although the installation of private umbilical cord bank for the autologue therapies is not forbidden by law or administrative regulations, the development of the public umbilical cord bank would be preferred for the public good. Now there remains no specific regulation for the umbilical cord blood. We could just try to interpret the regulations of the donation of blood and human tissues or cells in the Public Health Code for the possible applications to the umbilical cord blood. Nevertheless, there are many problems for interpretations, for the natures of these domains are sometimes different. Besides, now the France has faced a dilemma for the shortage of umbilical cord blood and has had to import it on the extra expensive costs. People begins to urge for the more national investments on the storage of umbilical cord blood, even begins to think about the possible resort to private umbilical cord bank. How to balance the private needs and the public good would be an inevitable task in the future regulations.
