本論文之研究目的有二：其一、本論文得以告知消費者許多可貴的資訊，例如自費儲存新生兒的臍帶血於商業私人臍帶血銀行，使用到自己所儲存的臍帶血之機會到底有多少？將來是否有「高效益」？公益（營）臍帶血銀行接管臍帶血之『無償儲存』業務，相對於商業私人臍帶血銀行是否較為合適？上述問題涉及到區別公益（營）與商業私人臍帶血銀行設立的雙軌制度之實益分析；其二、透由歐盟的法制與倫理道德觀點，去檢視臍帶血銀行的設立問題，可以得出一些研究結果或結論，使我們注入倫理道德之反省力，又兼具有法學以及現代生物科技之整合價值。再者，介紹重要國際臍帶血組織的運作情形，可供在我國整備臍帶血銀行的管理法制時之參考，實有撰寫本論文的重要性。

This article intends to achieve the following two purposes: First, this article aims to offer the general public more valuable information and truths about umbilical blood bank services. For example, commercial private umbilical cord blood banks have offered parents to pay for variety of services such as storing or conserving their babies9 umbilical cord blood, but what is the probability of using the donors' umbilical cord blood for themselves or for their close relatives in the future? Is there any "high effectiveness" that support the storages of umbilical cord blood for newborns' or for their close relatives' uses in future? The benefits of non-profit storage service provided by the Public (or national) umbilical cord blood banks vis-a-vis fee based service provided by commercial private umbilical cord blood banks? Such issues will raise the questions that wanted benefit analysis between the public (national) and commercial private umbilical cord blood banks. Second, the analysis for problems of umbilical cord blood banks through the European legal and ethical perspectives could provide deeper moral reflection on these topics as well as contribute to the integrations among laws and life science. Furthermore, by introducing some international organizations about umbilical cord blood banks, this article will not only be helpful to the establishment of national umbilical cord blood banks in Taiwan, but also will be important references for future law makings concerning umbilical cord blood banks.
