中文摘要: 土地與建築物均為獨立的不動產客體,本得單獨處分,但是若土地或者建築物所有權單獨處分,不論是轉讓或其他處分行為,將導致土地所有權與建築物所有權的主體不一致的情形,進而發生權利的衝突。本文以為,我國在立法規劃上,係採二個方向安排土地與其地上建築物間之法律關係。其一為透過事前或事後之手段,儘量使地上建築物之所有權與土地所有權合一。另一則為藉由法律之強制或強勢安排,儘量使建築物所有權與土地利用權合一。
本文舉出三種有關我國立法上儘量使地上建築物與土地所有權合一之規劃,包括區分所有建築物之處分一體化、典權一體化及併付拍賣(拍賣一體化),分別探討相關之法律規定,實務上所生之問題及相關之學說主張。而由本文之分析可知,其立法意旨即在貫徹地上建築物與其基地得以歸屬於同一人所有之立法目的。此亦為一勞永逸避免或終結土地之所有與占有分離局面之最佳方式。

英文摘要: Land and building are both independent real estate objects. However, if the ownership of land and building dispose separately, the handover or other actions of managements may lead to disagreements between land ownership/property right and building ownership/property right, hence resulting in a conflict of interests. Our nation constitutes two approaches addressing legal issues revolving the relationship between land and building property rights/ownership. The first enforces the unification of both rights through precedent or subsequent . The other involves legal enforcement and otherwise coercive arrangements to achieve integration.
This article give three kinds of our nations’ related schemes regarding the integration of both rights, including the integration of various buildings managements , dian integration, and the integration of the selling of land and property, and discusses the legal restraints and orders on related personnel, applications and real-life situations, and different perspectives and theories respectively. According to previous analogies, the core purpose of related law such that land ownership
rights and building property ownership rights integrate is to designate ownership and responsibilities of both objects to one individual. This is the most effective approach to resolve and prevent disputes between the ownership and rights in the two objects (lands and building) once and for all.
