中文摘要： 「保安處分」在刑事制裁中扮演著重要的角色，其不僅在矯治犯罪者再為犯罪之危險性，同時也存在防衛社會之功能。我國刑法上保安處分之規定在經歷時空的變遷後，是否仍夠發揮原有之功效，值得深入探討。本文以針對施用毒品者所設之保安處分為重心，分析目前我國法制上所存在之問題，而中華人民共和國於 2007 年所制定的「禁毒法」，其中所採取之禁毒政策實有值得借鏡之處，本文一併予以介紹，並分析兩岸法規上之利弊得失，期望有助我國在戒毒政策及法規上更加完善。

英文摘要： “Protection treatment” plays an important role in crime sanction. It works not only as the tool to correct the posibility of criminals' recommitment but also as social defense. Thus, it is worth studyingw hether or not the regulations in our law can still function as before as the time goes by. This thesis analyzes the problems in our law accordingto the protection treatment set up for the drugaddic ts. Since it is worthwhile to learn from the Law of the PRC on Narcotics Control established in 2007, this thesis would introduce this law. By analyzingt he pros and cons of the laws of Taiwan and of Mainland China, it is expected to help us improve our policies with regard to correcting the behavior of drugabuse.
