極權政體下之文官個人責任一向是個値得探究之議題，從政治、社會、法律等多個面向切入，往往產生相異的結論，但不論是那個面向，皆有其無法面面俱到之盲點。本文以漢娜鄂蘭的平庸之惡之觀點，評析集權主義下的文官個人責任，並從法本質的角度，提出超法規阻卻責任的另一思維核心。

The issue of the individual bureaucratic responsibility under the totalitarian rule has always been worth discussing. Although the discussions of this issue can be undertaken through various perspective, such as the political, social, and legal dimensions, and they thus lead to different conclusions, none of these discussions can generate a complete and comprehensive account of the issue. This essay employs Hannah Arendt’s argument of banality of evil to analyze the individual bureaucratic responsibility. Moreover, this essay attempts to present a different understanding of the liability of extra-legal by exploring the nature of law.
