本文透過有豐碩立法與實務運作成果之德國法比較觀察，特別是以該國「國際刑事司法互助法」為主軸，介紹涵蓋受判決人移交程序在內之國際刑事執行互助之基礎架構，以及相關國際刑事司法互助法之基本內涵。包含國際刑事執行互助之基本觀念、德國互助法之基本體系架構、規範關係及其具體規定、受判決人移交公約及其相關規範、德國與其他歐盟會員國及國際刑事法院間之刑事執行互助特點。供在此法領域仍屬起步階段的我國，有比較法之參考素材。並附帶簡評我國新近提出之「跨國移交受刑人法草案」，祈有助於我國國際刑事司法互助法之繼續發展，促進對此領域之更合理規範。

Through extensive research on German mutual legal assistance laws, especially the “Act on International Cooperation in Criminal Matters (AICCM) ”, and abundant judicial practice in this field in Germany, this paper introduces primarily the egal framework of international cooperation in executinng foreign criminal judgment, including the procedure for the transfer of sentenced persons, and the basic ideas of mutual legal assistance legislations in this country. The contents of this article includes hence the discussion over basic concepts of international cooperation/ mutual legal assistance in executing foreign criminal Judgment, specific provisions and their interrelationship of the AICCM. It also touches on the Convention on the Transfer of Sentenced Persons and its related Specifications, as well as the
characteristics of international cooperation in executing foreign criminal judgments in Germany, other EU Member States and the International Criminal Court. This thesis was particularly prepared with a view to providing some comparative points for Taiwanese law-drafting process in this field which is by now at its early stages of legislation. Incidental comments are brought forth on Taiwan’ Bill for Transnational Transfer of Sentenced Persons which was just proposed recently, in the hope of contributing anything to help with a healthier evolution of Taiwanese legislation about mutual legal assistance in criminal matters.
