世界各國皆面臨著高齡受刑人人口增加的現象，德國同樣面臨老年受刑人增加的現象，德國文獻上對此議題的討論主要有下列幾個重點：一、是否區分監禁的問題。二、健康照護與醫療問題。三、獄中適應問題。四、獄中工作與休閒活動。五、出監準備與釋放問題。因此，本文提出德國老年犯罪人與老年受刑人的官方統計數字與相關分析，作為問題現象的前提說明，再以上揭五個事項，介紹德國獄政上在法制面與實務面以及文獻研究中的狀況，以供我國關注老年受刑人議題者之參考。

For some time, the age structure converts in prisons and it is increasingly likely that the number of old people in prison continues to rise. The proportion of people over 60 years of inmates in Germany and in Taiwan is much higher than a few years ago. However, in Taiwan a concrete concept or the intentions, how to give proper treatment of older prisoners in prison, is most apparent. Despite the development of the old prisoners, the practical implementation and the authorities in Taiwan are not well aware of this problem and do not continue to search for solutions. There should be given the management principles of a humane prison system for old and very old people in prison in Taiwan. With the concept and the practical experience of the treatment of old prisoners in Germany could be brought for the Taiwanese prison a proposal review.
