憲法明文保障人民財產權，然而為了人類共同生活，所有權有其界限。其中，民法第 773 條規定，法令得限制土地所有權，即所謂所有權的社會拘束。所有權的社會拘束可分為二者，一為私法上之拘束，二為公法上之拘束。其中公法上拘束土地所有權，是否予以補償，在我國，以特別犧牲之理論定之。本文乃從民法第 773 條及相關法令對於土地所有權之限制是否予以補償的角度，探討行政法上的特別犧牲。

Constitution Expressly provided the property rights of people should be protected, however the right of ownership has its line for the common life of mankind. The Civil Code article 773 provides the ownership of land could be limited by the law and decree what we describe the right of society binding. Bound by the ownership society can be divided into two, one is the bound by private law, another is the bound by Public Law. Whether the ownership of land bound by Public law could be compensated with the theory of Special sacrifice in Taiwan. This report comes from the 773 of the Civil Code to explore the special sacrifice on the Administrative Law for the restrictions on land ownership and how compensate for the rights.
