基於人道、協助受刑人回歸社會等因素，國際間移交受刑人以使本國籍受刑人回國服刑，已經越來越普遍，而我國不但和巴拿馬簽訂有移交受刑人條約，與中國大陸之司法互助協議亦包括移交受刑人，同時，我國亦正嘗試與許多國家間進行移交受刑人。但是，移交受刑人，不論遣送外國受刑人或接收我國籍受刑人，都必須有法律規定國內程序，方能進行，因此，法務部按照國際通用的移交受刑人原則，制訂《跨國移交受刑人法》，做為移交受刑人之國內法源，本文以簡介該法內容為基礎，並附帶論及國際移交受刑人制度。

Cross-border transferring offenders, helping offenders serving their sentences in mother countries, grows rapidly in recent years. Though there are many reasons for this trend; humanity and correction are the two major ones. To follow this trend, Taiwan not only signed the Transfer Offender Treaty with Panama and also signed the Mutual Legal Assistance Agreement with mainland China, including this topic as well. In addition, Taiwan still seeks to transfer offenders with many other countries. Since sending foreign offenders as well as receiving Taiwanese offenders must be conducted on a solid legal base, the Ministry of Justice adopts many common international principles of transferring offenders to draft the “Cross-border Transfer Offenders Act”, which will be the domestic legal base of transferring offenders. This article tries to introduce this Act and briefly explain the major principles of international transfer offenders as well.
