司法院於 2013 年 1 月 10 日函請立法院審議之「司法院大法官審理案件法修正草案」增訂「程序參加」機制，就「國家機關聲請法規範違憲審查案件」、「立法委員聲請法律違憲審查案件」、「法官聲請釋憲案件」、「人民聲請釋憲案件」、「機關爭議案件」及「自治權限爭議與自治監督行為爭議案件」之釋憲案件類型，賦予憲法訴訟聲請人或兩造當事人以外之「第三人」，得聲請參與訴訟程序之法規範依據。此不僅為現行司法院大法官審理案件法所無，更未曾見櫫於司法院歷年所提各版本之司法院大法官審理案件法草案中。若此草案未來順利完成立法程序並施行，對我國釋憲制度將是一項重大變革。本文對草案所規定之程序參加制度進行體系化之介紹，並提出若干立法上之缺漏及建議，俾能使我國憲法訴訟程序更為健全建置。

Judicial Yuan called upon Legislative Yuan on January 10，2013 for deliberating a bill of the amendment of Constitutional Interpretation Procedure Act，in which the provision "participate in proceeding" is incorporated. It serves as the legal basis to grant petitioners or other third parties to join in a proceeding, as far as the following types of disputes are concerned: abstract judicial review litigated by government bodies，moved by representatives or judges, or litigated by people, disputes between governmental bodies and federalism disputes. This amendment is so unprecedented that its enactment would be a remarkable watershed for the judicial review in Taiwan. This article is dedicated to a systematical introduction of the provision "participate in proceeding" drafted in the bill and offers criticism as well as proposition de legeferenda that could contribute to institutional integrity of the judicial review.
