中文摘要: 視聽著作,之所以於近年成為討論與立法之焦點,實歸因於其與眾不同之本質。除了連續性系列影像為其獨有之特徵外,一視聽著作,尤其電影之完成,內中往往集聚並運用到其他類型之著作,隱含著許多人所付出之創意與心血,其間之互動關係繁複且多元,箇中權利之歸屬主體為何?內容及界限何在?視聽著作與其他著作間之法律關係何如?視聽著作之利用關係如何認定?凡此種種,皆因視聽著作之特殊性而富有探究之價值。
正因為電影等視聽創作於本質上之多樣性,世界各國於視聽著作有關之立法上各具特色,各有擅場。本文試圖透過比較法方式,研究各國有關視聽著作之定義、要件、歸屬、利用…等歧異之處,取他國法制之長,圖補我國法制之短。首先,本文將引介視聽著作之沿革以及國際間之態度與觀點。其次,本文將介紹國內外對於視聽著作不同之定義、要件與界限,並且進一步比較國內外視聽著作權利歸屬之認定與差別。接著,本文將分析國內外對於視聽著作利用之特別規定與其背後隱含之原理。最後,透過對各國法制之觀察,提供反思與我國立法上之建議。

英文摘要: Ever since the late 19th century, the flourish of the international film industry has made the copyright protection of audiovisual works an urgent demand for artists and studios. An audiovisual work, as a totally new and independent work, is the fruit of intellectual and creative contributions. It, as a derivative work as well, usually results from the emergence, combination and transformation of various sorts of existing works. Comparing to other subject matters of copyright, audiovisual work, due to the complications and intricacies of its nature, is so special that it has been treated differently in the copyright law. And hence the frames and contents of the related laws in different countries are quite distinct from each other. The reviewability of audiovisual works’ statutory provisions has become a frequently discussed issue for lawmakers and scholars around the world today.
This article attempts to make a comparative study so that we may learn the merits of other legal systems to improve the existing provisions of Taiwan. Following the introduction of the origin and development of audiovisual works both domestically and overseas, this article will further discuss different statutory definitions, prerequisites and limitations of audiovisual works. Then, the article will also analyze the special provisions on the aspiration and application of audiovisual works. In the end, the last section will conclude the article with reflection and suggestions for future legislation in Taiwan.
