本文採內容分析法,併用憲法釋義學,援引大法官許宗力、許玉秀於釋字第 596 號「平等原則」不同意見書的審查模式,期以檢驗立法機關制定中小學(含職業學校)卸任校長職務之教師不受《教師法》、《教育人員任用條例》應經學校教師評審委員會審議,即可回任教職規定之合憲性。公平、公正、公開乃學校聘用教師、教師受聘於學校相關作業恪遵之原則,卸任校長職務、非卸任校長職務兩類教師,同為合格教師,於聘任一事,具相提並論性;今特為卸任校長職務之教師所創設的獨尊、例外規定,明顯悖離體系正義,毋為保護重要公益所必要,且未現合理差別待遇的存在價值與正當有力的立法論據,該等律法規定恐無法通過憲法平等原則之審查與檢驗。

This study adopted Content Analysis and cited the investigating pattern of Grand Justices, Tzong-Li Sheu & Yuh-Shiou Sheu, regarding differing opinion paper of Judicial Yuan Interpretation No.596. in order to test the constitutionality of that primary and secondary school (including vocational school) teachers who quitted principal’s position were appointed directly to be full-time teachers, apart from the test of school teacher accreditation Committee postulated in “ Teachers Law”, “Education Personnel Appointment Regulations”. “ Fair, just and open “ is the principle of hiring teachers by schools. About appointment of teachers, both teachers who quitted principal’s position and teachers who didn’t have qualification and service experience of principal could be discussed contemporaneously. Exclusive prescription made intentionally for teachers who quitted principal’s position could violate apparently justice within system and not be imperative for public goods. Strong argument of positive discrimination concerned above couldn’t be seen. Revelent regulations couldn’t pass the test of constitutional principle of equality.
