社會保險法總論之建立固然有待立法，惟於立法之前，分析與檢討國內實務關於社會保險法總論相關課題所已表示之見解，應有助於社會保險法總論之建立。本文依據體系性之觀點，以社會保險法律關係為核心，從社會保險法律關係之當事人、社會保險法律關係之發生以及社會保險法律關係之內容等方面，挑選了「受僱勞工」之概念、勞工保險法上之申報制度、社會保險給付期待權與社會保險給付請求權等社會保險法總論上之重要課題，分析與檢討實務上之見解，希望有助於社會保險法總論之建立。

| 英文摘要： |
A general theory of social insurance law must be established. Therefore it is necessary to analyze opinions regarding to relevant issues discussed by courts and scholars in Taiwan.
Through a systematic approach, this article discusses the legal relationship of social insurance, including the parties, the occurrence, and the content. With an eye to establish a general theory of social insurance law, this article especially examines court's judgments related to the concept of "employees", the register systems defined by the Labor Insurance Act, and the expectant right to the benefits of social insurance. The conclusion of this paper is a step toward future legislation.
