國際商務活動的展開，個人資料流動至境外的可能性大增，而網路與資訊科技的快速發展，不僅改變資料傳輸及流通的方式，更使得資料的跨境移轉，成為輕易且常見之事。為避免個人資料被傳輸至缺乏妥適保護的國家或地區，用以規避內國法律之限制，國際組織針對資料跨境移轉問題，已從早期採取開放、甚至不希望各國施加不必要限制的態度，轉趨嚴格。本文聚焦探討個人資料跨境傳輸衍生的法制問題，於分析國際組織最新觀點與立法設計的基礎上，進一步檢視國內現行法制下資料跨境傳輸規範之妥適性，以及在國際保護機制參與上可能遭遇的相關難題，最終提出筆者之建議。

Due to the growth of vigorous international business, the possibility of personal data to be
transmitted internationally is highly increasing. The rapid development of internet and information technology not only transforms the mode of data transmission and circulation but also makes crossborder personal data transmission simple and common. In order to prevent personal data from transmitting to the country which lacks of proper regulations towards the protection of personal data for the sake of averting domestic law, international organizations hold strict attitude toward crossborder personal data transmission gradually instead of the former unrestrained policy. The purpose of this study is to discuss the problems relating to cross-border personal data transmission. On the basis of analyzing the latest points of views of international organizations and its legislative design, the author will look over the appropriateness of current domestic legal enactments, the difficulties or obstruction may meet and thus to bring up ultimate recommendations.
