針對中共遼寧號於 2013 年 11 月及 2017 年 1 月及 7 月先後行經臺灣海峽，中國大陸對外表示：「臺灣海峽為國際水道…，遼寧號依法享有國際法規定的海上航行和飛越自由…」，呼籲國軍只能監控，不能有其他敵對行動云云。非惟如此，中共戰機飛到海峽中線與我機對峙，亦時有所聞。面對這般情勢，臺灣海峽之法律地位為何？航行臺灣海峽權利究屬無害通過、過境通行抑或自由航行？各有論據。本文將就國際海峽之航行制度做基本介紹，並摘整國際法學者、有關國家的主張，針對中共稱臺灣海峽為「國際海域」之立場，檢視其國際法意涵，以及政府對各國通行臺灣海峽以「廣義無害通過」回應是否適當，最後提出個人之結論與建議。

According to China's Liaoning Aircraft Carrier cruising around Taiwan in November 2013 and January, July 2017. China Government declare that「the Taiwan Strait are international seas…the Liaoning has the right according to International Law to cruise」. Asking that the Taiwan Government can only do surveillance. Can't have any hostile actions. The PRC Fighters also flew near the center line of Taiwan Strait once in a while. Facing these difficulties, what is Taiwan Strait's legal status？Is patroling around Taiwan Strait belongs to an innocent passage, transit passage or right of navigation？ This article will discuss the rules of navigation in international seas, and discuss all the international law professor's opinions. It then analyses why PRC Government declaires that Taiwan Strait is international sea and its implication. In conclusion, it will offer advices relating to this question.
