隨著交通領域的數位化,驅動自動駕駛及智慧交通系統快速發展。將來透過車輛之間和車輛與交通基礎設施之間的數位通訊,可協助駕駛者做出適當決策並適應交通狀況,進而提升道路安全,交通效率以及駕駛舒適性。無論是載客或運輸貨物,自動駕駛將蒐集大量資料,相對提升使用者個人資料遭濫用及隱私洩漏的風險,因此,確保個人資料被安全,合法蒐集、處理及利用,同時允許合理地資料利用,並提升行政效率、促進產業創新,將成為重要之課題。本文將分析歐盟及德國對於自動駕駛及智慧交通系統的資料保護規定及實務經驗,以作為我國推動自動駕駛及智慧交通系統相關政策之建議。

With the digitization of the transport sector, the Automated driving and Intelligent Transportation System is emerging and rapidly developing. In the near future, the communication by digital connectivity between vehicles and between vehicles and transport infrastructure will help drivers to take the right decisions and adapt to the traffic situation, and can expect significant improvements in road safety, traffic efficiency and driving comfort. As well as transporting people and parcels automated vehicles will collect vast amounts of data, which will increase the risks of the misuse of user's personal data and privacy leak. As a result, it becomes an important issue to ensure that personal data is lawfully collected, processed, and used, while at the same time to allow reasonable and proper use of such data in order to enhance administrative efficiency and promote business innovation. Therefore, this article plans to analyze the data protection laws and practical experience of Automated driving and Intelligent Transportation System in EU and Germany, and hopes to provide some guidance on the promotion of Automated driving and Intelligent Transportation System for Taiwan.
