隨著時代改變，我國兵役制度，由原先以徵兵制為主、募兵制為輔之模式，朝向全面採取募兵制的方向進行。依照國防部規劃期程，我國預訂於民國 105 年底前實現全面募兵制的目標。為能確實達成募兵制的規劃目標，行政院於 103 年 11 月 21 日函請立法院審議《募兵制推動暫行條例草案》，希望藉由提高對志願役軍人的權益保障，吸引青年加入軍隊。
本文目的，除詳細檢討《募兵制推動暫行條例草案》在立法目的、條文結構、文字用語以及規範內容等方面，所存在之缺失或疑義，並針對相關缺失，嘗試提出修正意見或作法。希望本文的研究成果，能提供草案在立法審議上參考之用。

As times change, our system of military service originally was taken to the conscription-based, supplemented by mercenary mode, and then develops toward the direction of whole mercenary. In accordance with planning process of Defense Department, our country plan to achieve the goal of whole mercenary today before the end of 2016.To be able to achieve the goal of mercenary, the Executive Yuan requests the Legislative Yuan on November 21, 2014 to consider "The Draft Temporary Act for Promoting Mercenary n, hopes to improve protection of the rights of volunteer military, and attracting young people to join the army.
The author in addition to a detailed review of "The Draft Temporary Act for Promoting Mercenary" in terms of the legislative purpose, the provisions of the structure, content, text language and norms, the existence or absence of doubt outside, and for the relevant missing, tries to propose amendments, and hopes that results of this study can provide reference legislative review.
