中文摘要: 「現有巷道」的認定標準在法律形成原因方面分成上位階法源及地方位階法源,也發生何者係為其認定主管機關之爭議。在「現有巷道」的法律定性方面,因為公用地役關係之既成道路往往作為「現有巷道」之常見類型,但並非以既成道路為限,故涉及公用地役關係之重要討論,例如三個(不確定法律概念)要件、無尾巷及類推適用民法取得時效規定。然而,公用地役關係絕非「公用地役權」,也不同於民法地役權,但最近有發展人役權(人役關係)之趨勢及通行權之呼聲。一旦政府在私人土地鋪設柏油路面,即將涉及是否成立既成道路之認定,隨之,也產生公、私法院管轄權之爭議。「現有巷道」的司法救濟案件非常多,值得本文分析與論辨之。

英文摘要: The criteria of “existing laneway”, from the perspective of law establishment cause, could be divided into two groups: sources of upper level law or local law. Moreover, regarding the characterization of “existing laneway”, which usually contains (but is not limited to) the private preexisting roads based on public easement, it will involve essential discussion on public easement (e.g. three elements that are indefinite legal concepts, blind alley, and the analogy of applying prescriptive acquisition provisions under the Civil Code). However, the said public easement is neither the “public right-of-way” nor the “servitude of real property”, yet recently there are voices to develop easement in gross and the right of passage. Whenever the government starts to tar the roads on a private land, it will lead to the determination of whether a private preexisting road exists and subsequently, the jurisdiction dispute between administrative and civil courts. There are a great number of judicial relief cases relating to “existing laneway” worth discussion and analysis via this article.
