中文摘要： 所謂意定監護制度，簡言之，就是自己的監護人自己選的制度。民法除法定的成年監護制度外，於 2019 年 5 月 24 日立法院終於三讀通過意定監護之相關條文，使我國監護制度終於完成最後一塊之拼圖。本文除簡介日本之意定監護制度以比較我國與日本制度之不同，避免重蹈日本使用率過低之覆轍外，並針對此次意定監護制度之內容，包含意定監護契約之成立、生效、與法定監護之轉換以及意定監護得否排除法定監護之規定等部分加以評析，最後對於此次意定監護新制有待檢討之處，提出具體之修正建議。

英文摘要： The essence of the voluntary guardianship system is for a person to designate one’s future guardian(s). Upon the original legal guardianship (LG) law, the Civil Code had added provisions concerning voluntary guardianship (VG) on May 24, 2019 that completed the guardianship system of Taiwan. This article starts from introducing the VG system under the Japanese law. The comparative studies between laws of Japan and Taiwan may avoid the Japanese problem of VG low usage rate. This paper also makes a thorough examination on the newly promulgated VG system in Taiwan, including the making and effectiveness of a VG contract, the transfer between LG and VG, and the possibilities of the exclusion of LG by VG. Comments on the new VG system will then be presented to draw upon concrete suggestions for further amendments.
