長期以來,我國政府對勞動派遣之勞動力供給制度採自由放任政策,而法院實務也多肯認勞動派遣關係的合法性。然而,因勞動派遣關係與傳統勞動契約關係大不相同,依現有勞動相關法規,應如何解釋、適用於勞動派遣關係?而行政院勞工委員會為因應現實需要,在民國 99 年 1 月提出之勞動基準法部分條文修正草案亦針對勞動派遣關係制定相關規定,該修正草案之規定是否可有效解決目前爭議,均是值得研究之問題。 有鑑於此,本文謹從勞動派遣之定義出發,分析在勞動派遣關係下相關當事人間之法律關係,並針對勞動派遣實際適用現行勞動基準法可能引發之爭議問題,探討新修正勞動基準法草案關於勞動派遣制度之規定,並提出相關立法建議。

Our government has been lenient in policies regarding labor force supply provided by worker dispatching agencies, and most of our courts’ verdicts also admit the validity of the relationships in worker dispatching .However, since the legal relationships of worker dispatching are quite different from the traditional labor contract relationships, how should we interpret the legal relationship of worker dispatching with existing labor laws? Except that, according to the realistic need, the Executive Yuan Laborer Committee proposed a Labor Standards Law Draft on January 11, 2011. Partial articles of the revision draft also regulate the parties of worker dispatching. Whether can this revision draft solve present disputes effectively? Questions mentioned above are all worth studying. Concerning solving the existing disputes and making the Draft more consummate, this article will embarks on the definition of the relationships in worker dispatching. Then by ways of analyzing the legal relationships between parties, this article try to offer some suggestions about theoretical or practical issues of worker dispatching.
