中文摘要: 自消費者債務清理條例於 2008 年施行以來,我國司法實務上對廣大自然人聲請更生程序出現一種現象,會以債務者的資產負債比為理由,將其更生聲請駁回,對此發展,本文以臺灣臺北地方法院 106 年度消債更字第 172 號民事裁定為例,開展討論。
本文指出,法院認定債務人的「建物價值」過高,並以之為理由將其更生聲請駁回,會對我國廣大債務者的二元自由選擇機制造成衝擊,並對更生程序的「清算價值保障原則」形成直接挑戰,對我國消費者債務清理條例更生程序的發展影響深遠。所以,關於實務上如何運用「不能清償」與「清算價值保障原則」造成「更生不能」的現象,就是本文關注的焦點。
故,本文首先於第二章探討「清算價值保障原則」的雙重意義。接著,於第三章提出對「不能清償」與「清算價值保障原則」相互關係的討論,並於第四章就「建物價值」與「債務總額」的關聯性進行研討。最後,於第五章提出本文對司法實務上「更生不能」現象的再檢討,並為結論。

英文摘要: Since the implementation of the Consumer Debt Clearance Act in 2008, a phenomenon has been observed in natural persons’ applications of rehabilitation in judicial practice in Taiwan: Courts reject said applications on the basis of debtors’ debt-to-asset ratios. This study explored this phenomenon by discussing Taiwan Taipei District Court Xiao-Zhai-Geng-Zi Judgment No. 172 (2017).
This study identified that the Court determined the debtor’s property value to be excessively high and rejected the debtor’s application for rehabilitation based on such a reason. This judgment impacted the binary free-to-choose mechanism of enormous debtors and directly challenged the Principle of Liquidation Value Protection, thereby having a profound influence on the rehabilitation process in the Consumer Debt Clearance Act in Taiwan. Therefore, how to use insolvency and the Principle of Liquidation Value Protection to reject applications of rehabilitation in practice was investigated in this study.
This study examined the dual meanings of Principle of Liquidation Value Protection in Chapter 2 and provided discussion of the correlation between insolvency and Principle of Liquidation Value Protection in Chapter 3. Chapter 4 explores relevance between property value and total amount of debt. Chapter 5 provides reexamination of the phenomenon of rejected application for rehabilitation in judicial practice and concludes the study.
