中文摘要： 本文藉由不同生殖科技的倫理爭議與合法性指出，一項科技是否能被合法接受的關鍵往往在於其所能提供的利益而非爭議性，並據此探討代理孕母未能在臺灣取得合法地位的原因。進而基於此一政策脈絡分析，何以具有高度道德倫理爭議的同志婚姻可以被合法化，但合法的同性婚姻者卻無法合法生育其血緣子女。

英文摘要： By analyzing the relations between ethical issues and legitimacy of some assisted reproduction technologies, this paper points out that it is the profit that this technology generates, rather than the controversies, that makes such a technology be legally accepted. In addition, an explanation for the fact that surrogate mother remains illegal is found in this phenomenon. Finally, this paper tends to employ the same approach to examine how can highly controversial same-sex marriage be legalized whereas the reproductive right of such family is denied
