中文摘要： 未具合法醫師資格而執行醫療行為（業務）者，固然成立醫師法第 28 條之密醫罪；然而，醫師如係「逾越醫療行為（業務）範圍」，則不一定構成密醫罪。同理，未取得醫師及醫事專門職業人員資格者，如未依醫師指示，其執行醫療（輔助）行為（業務），始成立密醫罪；否則，應依各該醫事專門職業法規規定，論以處罰。

英文摘要： Those who are not legally qualified as medical practitioners (businesses) will certainly establish the fake doctor crime under Article 28 of the Doctors' Law. However, a doctor's "surpassing the scope of medical practice (business)" does not necessarily constitute a fake doctor crime. Similarly, those who have not obtained the qualifications of doctors and professional medical professionals fail to follow the instructions of the doctors, and they perform the medical (auxiliary) behavior (business) to establish the crime of fake doctor. Otherwise, they shall be punished according to the regulations of the professional medical regulations.
