我國地方政府自 2010 年 12 月 25 日以降形成五直轄市之建構規模，開?地方自治史上之新局面。原隸屬於臺北縣、臺中縣、臺南縣及高雄縣轄下之鄉（鎮、市），因所屬縣單獨改制或與其他地方自治團體合併改制升格為直轄市，致喪失原有之地方自治團體公法人屬性，「降格」為改制後直轄市內部之「區」行政層級。基此劇烈之組織變革，改制之四個新直轄市市政治理，遂遭遇區公所在現行法制下之組織及功能定位問題。本文認為，其面臨之區政治理問題與臺北市及原高雄市之區有別，故區公所在組織定性及業務功能上應另闢蹊徑。除應強化區公所之業務權責外，在組織編制上亦應滿足「在地服務」之要求。最後，更須正視各區自然及人文條件差異之事實，適度納入「依區制宜」之立法，以為分區治理之準據。

Since 25.12.2012 five special municipalities have been shaped under the regime of local governments in Taiwan and ushering in a historical new era of municipal corporation. Those towns and cities which were formerly subordinate to Taipei County, Taichung County, Tainan County and Kaohsiung County have lost their nature as public juristic person as theresult of such organizational reformation and thus been degradedas "district" inside the corresponding special municipality. According to this reformation, the city governances of these four new special municipalitiesare confronted by organizational and functional qualification problems of district office under the current regime. This essay holds that the confronted problems of district governance differ from those of Taipei City and of former Kaohsiung City. Therefore, solutions to the organization and service of district offices must be another way. Besides fortifying obligations of district offices, their organizational structure is supposed to meet with the requirement of local services as well. Finally the facts of natural as well as social diversity of every district must be taken seriously and the ad hoc approach should be put into proper account as the legal basis of district governance.
