從德國行政法近十餘年來的發展軌跡看來，不確定法律概念基於其實質內容上的「不確定性」，往往越來越被當成是國會立法調控能力弱化的表徵，而這種不確定性，更經常被認無異於法律規範內涵的稀釋。在這樣的背景之下，當代德國行政法學界對於「不確定法律概念」規範內涵的理解，在許多必須高度仰賴專業知識的事務領域，一方面越來越偏離傳統學理上對於概念語義明確性的預設，另一方面也越來越傾向於藉助其他相關學科知識，來彌補不確定法律概念規範濃度的稀釋。本文的目的，一方面在於透過對近十餘年來「不確定法律概念」在德國行政法領域發展歷程的觀察，分析此種概念類型的規範定位之所以發生變化的原因；另一方面更希望藉由批評與檢討當代許多對於「不確定法律概念」的理解方式，釐清「不確定法律概念」作法律概念的制度性意義何在。本文認，還原「不確定法律概念」的規範屬性，不僅能讓我們更清楚瞭解國會法律應如何發揮拘束行政行的功能，更有助於澄清法律相對於其他科學領域的任務特性及任務限制。

While the so-called "uncertain legal concepts" play a significant role in excluding administrative arbitrariness under the traditional presupposition that the courts are entitled to a comprehensive review on the administrative application of law, from the perspective of the "reformers", they are conversely regarded as a proof showing that, in view of its inevitable uncertainty, the law has lost its power of regulating the administrative decision-making. Through theoretical, methodological and institutional analyses, this essay purports not only to find out why and to what extent this functional change took place, but to examine the problems hidden behind the contemporary debates. Unlike the familiar viewpoint that only certain legal rules are capable of regulating the administrative power, this essay intends to clarify how a harmonized relationship between uncertain legal concepts and the binding force of law should be built.
