中文摘要: 由於人民對一般食品在安全意識上的強調與深化,並隨著生活品質的提升,大眾對於健康食品的需求也越趨重視。但不同於健康食品在專法規範下有其法律上的定義,在保健營養食品產值亦有成長的同時,卻仍適用食品安全衛生管理法之規定。因此,當一項產品於廣告上違法地宣稱其有醫療效能時,除了應確認適用何項法律外,對於行為要件該當與否之判斷,以及對於處罰之行為數的認定,都是需要釐清的問題。如此也才能落實對於國人在食的安全與食的品質上均能獲得確保。

英文摘要: In addition to the emphasis of food safety, advocated by and for the public, health food also has earned the attention of many people when quality of our life has been promoting in nowadays. Different from health food, which has its legal definition and even its own specific law to apply, dietary / nutritional food is still regulated under the Food Safety and Management Act, although its production value hit a record high. On the market, when a product declares its medical effects illegally, for the administrative penalty, we must figure out first the following issues: which regulation is going to apply? how to make sure its claim (advertisement) is against the rules? And, how many violations should be counted? Only when we have a clear understanding of these questions, the protection of food safety and food quality, especially for the health and nutritional, can be ensured and sustained.

一、健康食品管理法下的違法廣告行為之認定,可否適用食安法規範下所授權訂定的行為認定基準(是否該當「誇張」、「易生誤解」或宣稱「醫療效能」)?
二、前述的認定基準是否符合法律明確性的要求?
三、健康食品管理法下的違法廣告行為,在行為數的認定上,可否適用食安法規範下所授權訂定的行為數認定標準?
四、前述行為數認定標準可否排除最高行政法院決議對於一行為之認定?甚至除外於一行為不二罰原則之適用?易言之,可否透過法規命令作為認定標準,即便其可能牴觸傳統對於一行為之認識?
