本文嘗試由基本權利保護義務，以及基本權利前提要件等觀點出發，探究國家在疫情時期如何形構或強化基本權利行使所需之法律條件或現實環境，進而確保基本權利主體仍有最大之可能得以確實行使其受基本權利保障之各該行為。期望藉此能引發憲法學界對於此一議題之探討，並進而健全我國防疫法制之發展。

Starting from the perspective of the protective obligation of fundamental rights and the precondition of fundamental rights, this study aims to figure out the juridical conditions or reality environment for which the nation requisite to form or enhance the fundamental rights during the pandemic. And thus to ensure the subject of fundamental rights still has the greatest possibility to exercise its various acts. By doing so, this study expects to sensitize the constitutional law circle to discuss this issue. Further to strengthen the development of Taiwan’s pandemic prevention legal system.
