於現代社會中，行政機關藉由自動化設備之助而作成行政處分之情形，越來越普遍。此對於傳統行政處分之概念及作成，已造成相當之影響。又本於職權調查主義，行政機關應調查所有對當事人有利及不利之證據資料。惟在自動化行政處分中，對於當事人之重要陳述很可能被忽略掉。為因應此種情形，德國在其聯邦行政程序法中，增訂了第 24 條第 1 項第 3 句及第 35a 條。不過，有學者對此提出質疑，並引發相當之爭議。本文先釐清自動化行政處分之概念，並劃出與「電子化行政處分」及「以電子傳送之行政處分」之界限。其次，將以德國聯邦行政程序法第 35a 條及第 24 條第 1 項第 3 句規定為對象，探討該兩條規定之內容及學說爭議。最終，檢討我國法相關之規定，並針對是否參照德國法增訂於我國行政程序法中，提出本文之見解。

In modern society, it is more and more common for administrative agencies to make administrative acts with the help of automated equipment. This has had a considerable impact on the concept and formulation of traditional administrative acts. In addition, based on the principle of authority investigation, the administrative agency should investigate all the evidence and materials that are beneficial and detrimental to the parties. However, in automated administrative acts, important statements to the parties are likely to be ignored. In response to this situation, Germany added Article 24, paragraph 1, sentence 3, and Article 35a in its Federal Administrative Procedure Act. However, some scholars have questioned this and caused considerable controversy. This article first clarifies the concept of automated administrative acts, and draws a distinction between it and ''electronic administrative sanctions” and ''administrative sanctions by electronic transmission." Secondly, it will focus on the provisions of Article 35a of the German Federal Administrative Procedure Law and the third sentence of Article 24, paragraph 1, to discuss the content and doctrine disputes of these two provisions. Finally, review the relevant provisions of Taiwanese law, and put forward the opinions of this article on whether to refer to German law to add to the administrative procedure law of our country.
