中文摘要: 從行政管制的角度來看,既謂「管制」,就應當要有法令規範以為依據。而這些規範與措施,不論是立法者所制定、抑或是在授權下由主管機關所為之,不僅一方面要能確遵憲法之誠命,且在面對快速變遷的主客觀環境下,以及要能在具備科學規範理性之同時,能夠積極地、適切地,使得受規範者以及受影響之大眾,得以與時俱進、充分以對。美國印第安納大學 Maurer 法學院 John Applegate 教授甚至指出,相關規範還必須具備應對前述需要往往也在不斷地變化之能力。而當管制與科學結合,固然強化了規範的正當性,但卻也帶出許多應當謹慎以對、且為猶待解決的問題。不僅是其關係著、乃至於影響到權力之間的關係、甚至位移,也在於決策正當程序實質內涵的應有的建構。本文即嘗試以管制科學,結合風險行政,介紹與分析在比較法上美國的經驗與所著重之爭點。期冀藉此提供國人在傳統行政法所討論的議題之外,能以科際整合的方式理解正當程序以及程序正義應如何在風險行政下獲致充分實踐。

英文摘要: From the perspective of administrative regulation, for the so-called "regulation" shall be based on the rule of law. Laws, rules, or some relevant specific measures adopted by the agency, according to the legislative delegation, shall not only must meet the requirements of constitutional mandates, but also need to fulfill the promises that the government will have the ability to face and respond to the rapid change for the internal and external environment positively and appropriately, based on the reasonably regulatory science. Meanwhile, for the regulated and the public can anticipate and understand what regulations they need to obey. Moreover, scholar has emphasized that even for these needs and requirements which might also change, the regulation itself must have the ability to deal with. Although science can justify the regulations, there are more issues coming with it. These issues would also influence the separation of powers since the administration might have incentive to manipulate it. Therefore, how to truly realize the content of science and its context will be a prerequisite issue for the science-based decisions. In this paper, I would like to use the multidisciplinary and comparable legal studying approach, for regulatory science, to introduce and analyze what the main concerns the States might focus on for rethinking what we need in Taiwan. In doing this way, there should be another different point of view, different from our traditional approach under the civil legal system, to get understanding how the due process and procedural justice can be realized under the risk regulation.
