英文摘要: The Safe Harbor mechanism shall apply not only to Copyright Law, but also to other types of creative subject matters regulated by Trademark Act, Patent Act and Trade Secret Act; It should also be extended to other types of online platforms, such as social media platforms and virtual realty; The mode of control should still be carried out by individual legislation; Platform operators are “the lowest cost avoiders” and should be held accountable.
The drafted Digital Intermediary Service Act should be formulated to regulate non-creative subject matters, and its connection services include social media platforms, but virtual platforms have not yet been encompassed; The draft refers to the Manila Principles and the Santa Clara Principles, which intend to hold platform operators accountable, but not to actively investigate or monitor illegal activities; It intends to stipulate that “after becoming aware of the illegal content, immediately remove the information or restrict its access”, and has a temporary warning provision.
The involvement of artificial intelligence brings both challenges and helps, for example, it will give rise to issues such as rights holders and The issue of protecting the subject matter, but AI assists in content moderation, and a “right of objection to AI” should be established to ensure the protection to general public.
