受刑人的投票權在我國是一個被迴避的議題，而且在實務上因法令的規範，導致受刑人無法進行投票。受刑人的投票權在許多國家已不再是一個問題，但也是歷經了相當時間的法制改革才進展到受刑人可以投票的狀況。本文先介紹歐洲相關人權公約等等的規範以及歐洲人權法院關於受刑人投票權的案例，再以英國與德國就受刑人投票權的法制發展加以闡述。最後再就上述我國受刑人投票權之行政法院判決提出評析，並對於有關受刑人選舉投票的問題提出法制與實踐的建議。

The inmates voting right is an almost forgotten issue in Taiwan. In actual practice, due to legal norms, inmates cannot vote. The right to vote for inmates is no longer an issue in many countries, but it has taken a long time for legal reform to progress to a circumstance that inmates are allowed to vote. This article introduces the norms of related European human rights conventions and describes the cases of the European Court of Human Rights on the inmates voting right as well as the legal development of the inmates voting right in the United Kingdom and Germany. Finally, this article will analyze on the above administrative court judgment on the inmates voting right in Taiwan, and put forward legal and practical suggestions on the issue of the inmates voting right.
