隨著經濟與社會發展，訴願案件的類型，從撤銷訴願擴至請求行政機關就申請事件作成行政處分之課予義務訴願。行政院於 2022 年 5 月 19 日提出訴願法修正草案，於草案第 2 條第 2 項明定駁回處分之訴願類型，與第 2 條第 1 項不服機關應作成行政處分而不作為之訴願，共同建構完整的課予義務訴願制度，並與行政訴訟法第 5 條第 2 項針對駁回申請的課予義務訴訟互相對應，草案也新增若干與課予義務訴願有關之規範。
本文從訴願權之保障、訴願制度之功能，及課予義務訴願之救濟目的，分析課予義務訴願的實務運作，觀察課予義務訴願之發展趨勢，並探討課予義務訴願與課予義務訴訟之關聯性。

Due to economic and social development, the types of administrative appeals have expanded from withdrawal appeals to appeals for requesting administrative actions on the application matter. On May 19, 2022, the Executive Yuan proposed the draft amendment to the Administrative Appeal Act. The Article 2, paragraph 2 of draft amendment stipulates the type of administrative appeals against the rejections of the application cases, which constructs with the type of appeals due to inaction of agencies according the Article 2, paragraph 1 of the Administrative Appeal Act, a complete system of obligation appeal and is to correspond to the obligation litigation in Article 5 of the Administrative Litigation Act. Several new provisions of obligation appeals have been amended in the draft. This article analyzes the practice of obligation appeals from the perspective of the protection of the right to appeal, the function of the appeal system, and the purposes of obligation appeals. It also observes the development trend of obligation appeals, and discusses the relationship between the obligation appeals and the obligation litigations.
