筆者於 2024 年 4 月參與立法院「人工生殖法」修正草案公聽會，當時對於是否納入代理孕母制度存在爭議。衛生福利部在草案公布後收集 600 餘則意見，約八成反對代孕，遂欲提出「代理孕母完全脫鉤」版本。本文針對 2024 年 5 月 14 日公布草案所採「意定雙親」制度進行評析，探討其對親子關係的影響，並如何在法制上平衡親權穩定、代孕契約履行、代理孕母權益與代孕子女最佳利益。

In April 2024, the author attended a public hearing on the amendment to the Artificial Reproduction Act, where the inclusion of surrogacy was debated. After the draft's announcement, the Ministry of Health and Welfare collected over 600 opinions, with approximately 80% opposing surrogacy, leading to the proposal of a "complete separation" approach. This article analyzes the “Intended Parents" principle in the draft released on May 14, 2024, examining its impact on parent-child relationships and how the legal framework can balance parental rights, the enforcement of surrogacy contracts, the rights of surrogate mothers, and the best interests of surrogate-born children.
