Supreme Court Year 110 Tai-Shang-Zi No. 584 Civil Judgment involves a licensing dispute concerning an exhibition of Hello Kitty, a famous character managed by Sanrio Co., Ltd. This article is intended to use other court decisions and news reports to interpret the dispute as a case that Sanrio was confronted with a licensee with a fraudulent background or bad reputation. This paper further explains what a character licensor may learn from this incident. A character licensor should establish a mechanism to prevent itself from entering into a cooperation relationship with such a fraudulent licensee. There must also be a mechanism to properly end the relationship when the parties’ licensing contract is breached. Three specific suggestions are proposed:(1)requesting full disclosure of a licensee’s business reputation;(2)placing a sales limit on license mark tabs;(3)requiring in a contractual clause that upon a licensor’s request a licensee must deliver unsold items to the licensor for destruciton.
