自 COVID-19 疫情爆發以降，國內法學界對政府的諸防疫舉措已有不少檢討。與此相對，就防疫行政組織則較少受到關注，這或是因行政組織主要被期待發揮體系建構之功能，而非直接解決個別具有急迫性的問題。然而，由於行政組織非以自我為目的，而是為達成特定目的所設，故其與任務間應有一定之手段與目的關聯，質言之，其設置與否，以及如何設置，均應取向於行政任務。為分析防疫行政組織之框架合理性，本文先描述現行防疫組織的規範架構及實際運作，並以防疫過程中司法裁判實務所生爭議為例，省思防疫行政組織，尤其是特設的指揮中心設計，是否符合行政組織應助成行政任務之要求；最後則以上述檢視為基礎，嘗試提出對於防疫組織架構之調整建議。

Since the outbreak of COVID-19, the legal academia has made various criticisms of the administrative measures for epidemic prevention in Taiwan. In contrast, less attention has been paid to administrative organizations for epidemic prevention because administrative organizations are expected to build up institutions systematically rather than directly solve individual problems of an emergency. However, administrative organizations are not the end in themselves, but are means, i.e., established to achieve specific purposes. The administration organizations, as means, should be built to properly serve the end, i.e., certain administrative tasks. This article begins with describing the legal structure and operation of the epidemic prevention organization. Then, this article uses the controversies arising from judicial decisions during the epidemic prevention as examples to reflect on whether the administrative organization for epidemic prevention, especially the design of the Central Epidemic Command Center, actually contributes to the administrative tasks as the law requires. Finally, based on the analysis from earlier sections, this article proposes suggestions to adjust the organizational structure of epidemic prevention.
