藝術創作的表達在自由創作之前提下才有發揮之可能,藝術之發展也才能夠因此突破藝術表現之疆界而往前再邁開幾步。普普藝術在藝術史上占有一席之地,其所創作的方式即是利用原本大眾文化所熟知的圖像加以改造,進而達到諷刺大眾文化的庸俗或迂腐,其中「利用」原創作與普普藝術的「原創」時常屬於一體兩面,難以完全區隔。美國最高法院在 2023 年 Andy Warhol Foundation v. Goldsmith 的判決中,多數意見認為 Andy Warhol 利用攝影師 Lynn Goldsmith 的照片創作近似於原作的普普藝術風格圖像,未能事先取得授權,且不構成合理使用,須負擔損害賠償責任。不同意見則認為多數意見的作成,對未來藝術的發展有可能造成阻礙,侵蝕藝術創作上自由創作的基石。本文先從美國最高法院判決切入觀察,企圖尋找我國法院判決關於合理使用判斷的相關因素與發展。

Artistic creation flourishes only under the premise of creative freedom, which enables art to transcend established boundaries of expression. Pop Art, as a significant movement in modern art history, often appropriates familiar images from mass culture and transforms them to critique the vulgarity or rigidity of popular culture. In this context, the distinction between “use” of preexisting works and the “originality” of Pop Art is often blurred. In Andy Warhol Foundation v. Goldsmith (2023), the United States Supreme Court held that Warhol’s adaptation of Lynn Goldsmith’s photograph did not constitute fair use, as it closely resembled the original and lacked prior authorization, thereby imposing liability for damages. The dissenting opinion warned that such reasoning could stifle future artistic development and erode the foundation of creative freedom. Using this ruling as a point of departure, this article examines how Taiwanese courts have assessed fair use, with particular attention to the factors and doctrinal developments that shape their judgments.
